HSCAssociate Managed Tutoring Terms

These Managed Tutoring Terms (“Tutoring Terms”) apply to tutoring services arranged and managed by HSCAssociate Pty Ltd (“HSCAssociate”, “we”, “us” or “our”).

They apply in addition to the HSCAssociate Terms of Use and Privacy Policy.

Where these Tutoring Terms deal specifically with managed tutoring, they apply to that service.

1. Managed Tutoring Service

HSCAssociate provides a managed tutoring service that may include:

  • receiving tutoring enquiries;
  • matching students with suitable tutors;
  • coordinating lesson arrangements;
  • processing customer payments;
  • administering tutoring relationships;
  • communicating with parents, students and tutors; and
  • providing other operational support relating to tutoring.

HSCAssociate may engage tutors as independent contractors to deliver tutoring sessions.

The customer purchases the tutoring service from HSCAssociate.

2. Tutor Eligibility and Matching

HSCAssociate may use eligibility requirements when selecting tutors, including academic results, subject performance, experience and other factors we consider relevant.

A tutoring request does not guarantee:

  • availability of a particular tutor;
  • acceptance by a requested tutor;
  • a particular commencement date;
  • a particular lesson time; or
  • an ongoing tutoring relationship.

We may suggest or assign another suitable tutor where the requested tutor is unavailable.

3. Parents, Guardians and Students

Where the student is under 18, a parent or guardian may be required to:

  • submit or approve the tutoring request;
  • provide payment details;
  • agree to these Tutoring Terms;
  • manage billing or cancellation matters; and
  • provide information reasonably necessary to administer tutoring.

The parent or guardian who purchases tutoring is responsible for ensuring that the student understands the relevant expectations applying to tutoring sessions.

4. Tutoring Requests

A parent or student may submit a tutoring request identifying information such as:

  • subject;
  • year level;
  • preferred days or times;
  • requested tutor, if any;
  • learning goals; and
  • other relevant tutoring requirements.

Submitting a request does not create a confirmed tutoring booking.

A tutoring arrangement becomes confirmed only when HSCAssociate communicates confirmation of the applicable tutor, timing and any required payment arrangement.

5. Tutor Acceptance

HSCAssociate may offer a tutoring request to a tutor.

A tutor may accept, decline or propose a different commencement time.

Where a tutor proposes a material change to the requested arrangement, the parent or customer may be required to expressly confirm the revised arrangement before tutoring begins.

6. First Lesson

HSCAssociate may permit a first lesson to occur before an ongoing payment method is established.

The applicable first-lesson arrangement will be communicated before the lesson.

Unless HSCAssociate expressly states otherwise, a first lesson is not a free trial.

The fact that a customer decides not to continue after the first lesson does not automatically mean that the first lesson was free or refundable.

Any amount payable for the first lesson will be disclosed before or as part of the tutoring arrangement.

7. Ongoing Lessons

If tutoring continues after the first lesson, lessons may operate on an ongoing basis according to the agreed schedule.

Unless otherwise agreed:

  • the next lesson is expected to proceed according to the existing arrangement;
  • the customer is responsible for notifying HSCAssociate of any cancellation or requested change;
  • lesson duration and frequency will follow the applicable tutoring arrangement; and
  • HSCAssociate may coordinate future lessons between the student and tutor.

Tutoring does not need to continue indefinitely and may be ended in accordance with these Terms.

8. Lesson Price

The tutoring price charged to the customer will be disclosed before the relevant paid tutoring arrangement begins.

Where tutoring is charged by time, the amount payable may depend on the length of the lesson.

The customer price is the amount charged by HSCAssociate for the tutoring service.

A tutor's separate contractor remuneration is a private arrangement between HSCAssociate and the tutor and does not affect the price payable by the customer.

9. Payment Authorisation

Payments may be processed through a third-party payment provider such as Stripe.

Where ongoing tutoring requires recurring or off-session payments, HSCAssociate may ask the customer to provide or authorise a payment method for future lessons.

By agreeing to an ongoing payment arrangement, the customer authorises HSCAssociate and its payment provider to charge the agreed amounts for tutoring provided under that arrangement, subject to these Terms.

The customer must provide accurate billing information and keep the payment method reasonably up to date.

10. Off-Session Payments

Where the customer has authorised future payments, HSCAssociate may process payment for a lesson without requiring the customer to re-enter payment details for every session.

We will only process off-session payments in accordance with the authorised tutoring arrangement and applicable law.

The amount charged should correspond to the relevant lesson or applicable cancellation charge.

11. Payment Failures

If a payment fails, HSCAssociate may:

  • request an updated payment method;
  • retry the payment where permitted;
  • pause further tutoring; or
  • take other reasonable steps to recover an outstanding amount.

We will not intentionally charge amounts beyond those authorised under the applicable tutoring arrangement.

12. Cancellation by the Customer

Unless otherwise stated in the applicable tutoring arrangement, a customer should provide at least 48 hours' notice if they wish to cancel a scheduled tutoring lesson.

Where less than 48 hours' notice is provided, HSCAssociate may charge the full scheduled lesson amount.

This reflects the tutor's reserved time and limited ability to offer that time to another student.

A cancellation charge will not be applied where doing so would be inconsistent with the Australian Consumer Law or where HSCAssociate determines that an exception is appropriate.

13. Rescheduling

Requests to change a scheduled lesson should be made as early as reasonably possible.

A requested change is not confirmed until HSCAssociate or the tutor, as applicable, confirms the revised arrangement.

If a requested rescheduling falls within the applicable cancellation period and cannot reasonably be accommodated, the ordinary cancellation policy may apply.

14. Tutor Cancellations

If a tutor is unable to provide a scheduled lesson, HSCAssociate will take reasonable steps to:

  • reschedule the lesson;
  • arrange an alternative tutor where appropriate; or
  • provide another suitable remedy.

The customer will not be charged for a lesson that HSCAssociate or the tutor fails to provide, except where an agreed alternative is provided.

15. Ending an Ongoing Tutoring Arrangement

The customer may end an ongoing tutoring arrangement by notifying HSCAssociate.

Ending the arrangement prevents future lessons from being scheduled or charged after the applicable cancellation period.

Ending tutoring does not automatically refund:

  • lessons already provided;
  • valid cancellation charges; or
  • payments otherwise lawfully due.

HSCAssociate may also end or pause a tutoring arrangement where reasonably necessary, including because of:

  • tutor unavailability;
  • repeated payment failures;
  • serious misconduct;
  • safety concerns;
  • persistent non-attendance; or
  • other circumstances making continuation unreasonable.

Where practical, HSCAssociate will communicate the reason and any next steps.

16. Online Delivery

Unless expressly agreed otherwise, HSCAssociate managed tutoring is delivered online.

Lessons may be conducted using video-conferencing services such as Google Meet.

Students are responsible for:

  • having a suitable device;
  • maintaining a reasonable internet connection;
  • joining on time; and
  • using the meeting link appropriately.

A student's own technical problem does not automatically entitle them to a refund.

If a substantial technical failure attributable to HSCAssociate or the tutor prevents a lesson from being delivered, we will take reasonable steps to reschedule the lesson or provide another appropriate remedy.

17. Communications

HSCAssociate may communicate with customers about tutoring through email and other authorised communication channels.

For privacy and operational reasons, HSCAssociate may limit the direct exchange of personal contact details between tutors and families.

Customers and tutors must not use HSCAssociate systems to harass, threaten or improperly contact another person.

18. Student Safety and Conduct

Students, parents and tutors must behave respectfully and appropriately.

HSCAssociate may take reasonable action where there is:

  • harassment;
  • threatening behaviour;
  • inappropriate communication;
  • discrimination;
  • sexual misconduct;
  • serious disruption;
  • misuse of personal information; or
  • conduct creating a safety concern.

Depending on the circumstances, this may include ending a lesson, changing the tutor, suspending tutoring or terminating the tutoring arrangement.

19. Tutors

Tutors delivering services through HSCAssociate may be engaged by HSCAssociate as independent contractors.

HSCAssociate is responsible for administering the customer tutoring arrangement.

Tutors are responsible for delivering tutoring with reasonable care and skill and complying with applicable HSCAssociate policies and requirements.

Nothing in these Terms gives a customer any right to know a tutor's private contractor remuneration or commercial arrangement with HSCAssociate.

20. Educational Nature of Tutoring

Tutoring is intended to provide educational support.

Tutors may assist with:

  • understanding course content;
  • developing subject skills;
  • exam preparation;
  • practice questions;
  • study strategies;
  • feedback on student work; and
  • other legitimate educational support.

Tutors must not complete school assessments, examinations or other work dishonestly on behalf of a student.

21. No Guaranteed Academic Result

HSCAssociate does not guarantee:

  • a particular HSC mark;
  • a Band 6 or E4;
  • a particular ATAR;
  • a school assessment result;
  • university admission; or
  • any other specific academic outcome.

Academic results depend on many factors, including the student's effort, attendance, preparation and circumstances outside HSCAssociate's control.

22. Student Work and Materials

Students retain ownership of their original work.

Where a student shares work with a tutor or HSCAssociate for educational purposes, the student permits that work to be used to provide the tutoring service and related feedback.

HSCAssociate educational resources and tutor materials remain subject to applicable intellectual property rights.

Students must not reproduce or distribute paid HSCAssociate resources except where permitted.

23. Privacy

Personal information relating to students, parents and tutors is handled in accordance with the HSCAssociate Privacy Policy.

This may include information required for:

  • matching;
  • scheduling;
  • communications;
  • payments;
  • lesson administration;
  • customer support; and
  • safety.

24. Refunds

HSCAssociate does not generally provide refunds solely because a customer:

  • changes their mind;
  • no longer wants tutoring;
  • fails to attend;
  • fails to provide sufficient cancellation notice; or
  • decides not to continue after a lesson that was properly provided.

This does not affect rights under the Australian Consumer Law.

Where a tutoring service is not provided as required by law, the customer may have rights to an appropriate remedy.

25. Australian Consumer Law

Tutoring services come with consumer guarantees that cannot be excluded under the Australian Consumer Law.

Nothing in these Tutoring Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded.

Services must, among other things, be provided with due care and skill and be reasonably fit for any purpose made known in circumstances where the law provides that guarantee.

Remedies may be available where a service does not comply with applicable consumer guarantees.

26. Complaints

If you have a concern about:

  • a tutor;
  • a lesson;
  • billing;
  • cancellation;
  • safety;
  • conduct; or
  • another tutoring matter,

please contact HSCAssociate as soon as reasonably possible.

We will consider the issue and take reasonable steps to investigate and respond.

27. Changes to Tutoring Arrangements

HSCAssociate may make reasonable operational changes where necessary, including:

  • changing a tutor;
  • changing scheduling arrangements;
  • changing communication methods;
  • changing video-conferencing providers; or
  • changing administrative processes.

We will not intentionally remove the fundamental benefit of a paid tutoring service without providing an appropriate alternative or remedy where required.

28. Changes to These Terms

We may update these Tutoring Terms from time to time.

The current version will be published with its latest update date.

Where a change materially affects an existing paid tutoring arrangement, we will provide notice where reasonably appropriate or required.

29. Governing Law

These Tutoring Terms are governed by the laws applicable in New South Wales, Australia.

Nothing in these Terms limits any rights available under applicable Australian consumer law.
