HSCAssociate Class Terms and Cancellation Policy

These terms apply to paid HSCAssociate online classes operated by HSCAssociate Pty Ltd.

They apply in addition to the HSCAssociate Terms of Use and Privacy Policy.

1. Class Enrolment

A class enrolment provides the enrolled student with access to the class program described on the relevant enrolment page.

Unless otherwise stated, this may include:

  • scheduled live online lessons;
  • access to recordings of lessons where recordings are provided;
  • class-specific educational resources;
  • practice materials and model responses; and
  • other inclusions expressly stated on the enrolment page.

The HSCAssociate Platform subscription is not included unless expressly stated.

2. Payment

The full class price displayed at checkout is the total price payable for the enrolment.

Payment must be successfully completed before an enrolment is confirmed.

Where a parent or guardian purchases a class for a student, the student nominated during enrolment will receive the relevant class and resource access.

3. Class Dates and Attendance

Classes are delivered according to the timetable shown at the time of enrolment.

Students are responsible for attending scheduled sessions and joining with a suitable internet connection and device.

A student's inability to attend a scheduled class does not, by itself, entitle the student to a refund.

Where a recording is made available, an absent student may use the recording to catch up.

4. Student Cancellations and Change of Mind

Except where required by the Australian Consumer Law or expressly agreed by HSCAssociate, HSCAssociate does not provide refunds solely because a student:

  • changes their mind;
  • decides they no longer wish to participate;
  • becomes unavailable for a class;
  • fails to attend a scheduled class; or
  • does not make use of the resources or recordings provided.

Any discretionary refund or credit offered by HSCAssociate does not affect a customer's rights under the Australian Consumer Law.

5. Cancellation or Rescheduling by HSCAssociate

HSCAssociate may reasonably reschedule a class where necessary due to instructor illness, technical problems, emergencies or other circumstances outside reasonable control.

Where practicable, students will be given reasonable notice and the class will be rescheduled or an appropriate alternative will be provided.

If HSCAssociate permanently cancels a class program and cannot provide the remaining services, affected customers will receive an appropriate refund for the unprovided portion of the service.

6. Instructor Changes

HSCAssociate may substitute an instructor where reasonably necessary.

Any substitute instructor will be selected having regard to the subject and nature of the class.

An instructor change alone does not automatically entitle a customer to a refund, except where required by law or where the change materially alters the service purchased.

7. Recordings

Classes may be recorded for educational purposes.

Where a class is recorded, students will be informed appropriately.

Recordings may capture a participant's name, voice, messages or other participation in the class.

Students who do not wish to appear visually in a recording should keep their camera switched off where permitted.

Recordings are provided for the personal educational use of enrolled students only.

Students must not reproduce, publish, distribute, sell, share or make recordings available to other people without written permission from HSCAssociate.

8. Resource Access

Class-specific resources and recordings are provided through the student's HSCAssociate account for the access period stated at the time of purchase.

Unless otherwise stated, resources are provided for personal, non-commercial educational use only.

Account-based access does not transfer ownership of the underlying intellectual property to the student.

Resources and recordings must not be:

  • redistributed;
  • uploaded publicly;
  • resold;
  • copied for commercial use; or
  • shared with people who have not purchased or been granted access.

9. Conduct

Students must behave respectfully during HSCAssociate classes.

HSCAssociate may take reasonable action where a participant seriously or repeatedly disrupts a class, harasses another participant or instructor, shares inappropriate material, or otherwise substantially interferes with the learning environment.

Depending on the seriousness of the conduct, this may include warnings, muting or removal from a session, or termination of class access.

Any decision affecting a student's paid access will be made reasonably and subject to applicable consumer law.

10. Technology

Online classes rely on internet, video conferencing and other technology services.

HSCAssociate will take reasonable steps to deliver scheduled classes.

HSCAssociate is not responsible for technical problems caused solely by a student's device, internet connection or other systems outside HSCAssociate's reasonable control.

If a substantial technical failure attributable to HSCAssociate prevents delivery of a class, HSCAssociate will take reasonable steps to provide the service through a rescheduled session, recording, alternative delivery or other appropriate remedy.

11. Educational Outcomes

HSCAssociate classes are educational support services.

HSCAssociate does not guarantee a particular HSC mark, ATAR, school assessment result, university admission outcome or other academic result.

Individual outcomes depend on many factors, including student effort, attendance, preparation and circumstances outside HSCAssociate's control.

12. Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.

If a service has a major failure, consumers may have rights including cancellation of the service and a refund for the unused portion or compensation for its reduced value.

Other remedies may apply where a service does not meet applicable consumer guarantees.
