HSCAssociate Terms of Use and Purchase Terms

These Terms of Use and Purchase Terms (“Terms”) apply to your use of HSCAssociate websites, applications, educational platforms, study resources, subscriptions, digital products and other services provided by HSCAssociate Pty Ltd (“HSCAssociate”, “we”, “us” or “our”).

By creating an account, using our services or purchasing a product, you agree to these Terms.

Our Privacy Policy also applies to your use of HSCAssociate.

Additional terms may apply to particular services, including online classes and tutoring. Where additional terms apply, they form part of your agreement with us.

1. HSCAssociate Services

HSCAssociate provides educational products and services that may include:

• access to the HSCAssociate Platform;
• AI-assisted marking and educational feedback;
• practice questions and study tools;
• performance and progress tracking;
• educational resources and study guides;
• HSC Pass products;
• online classes;
• tutoring-related services; and
• other educational products or services described on our website.

The exact inclusions, access period and price for a product are those displayed to you at the time of purchase.

2. Accounts

Some HSCAssociate services require an account.

You must provide accurate information when creating and maintaining an account.

You are responsible for maintaining the confidentiality of your login credentials and for activity occurring through your account.

You must not:

• share your login credentials with another person for the purpose of giving them unauthorised access;
• sell or transfer your account;
• attempt to access another user's account;
• interfere with the security or operation of HSCAssociate; or
• use the service for unlawful or fraudulent purposes.

3. Students Under 18

HSCAssociate is designed in significant part for secondary school students, including users under 18.

Where appropriate, a parent or guardian may create, manage or pay for services for a student.

For certain purchases or services, HSCAssociate may require a parent or guardian to act as the purchaser or provide relevant consent.

Where a parent or guardian purchases a service for a student, the purchaser agrees to these Terms and is responsible for ensuring the student understands any terms relevant to their use of the service.

4. Prices

The price displayed for a HSCAssociate product or service is the amount payable for that product or service unless clearly stated otherwise.

Prices are displayed in Australian dollars unless otherwise stated.

We may change prices for future purchases.

A price change will not retrospectively alter the price already paid for a completed one-time purchase.

For recurring subscriptions, any change to the amount charged will be communicated as required before the new price takes effect.

5. HSCAssociate Platform Subscription

The HSCAssociate Platform may be offered as a recurring subscription.

Where the Platform is offered at A$60 every four weeks, this means:

• you are charged A$60 when the subscription begins;
• the subscription automatically renews every four weeks;
• the applicable payment method is charged A$60 at each renewal unless the subscription is cancelled before the next renewal; and
• the subscription continues until cancelled.

The checkout page will display the applicable subscription price and billing frequency before payment.

Cancelling a Platform subscription

You may cancel your recurring subscription at any time through the available account or billing controls or by contacting HSCAssociate where assistance is required.

Cancellation stops future renewals.

Unless otherwise required by law, cancelling does not automatically refund a payment that has already been validly processed.

After cancellation, you may continue to use the paid subscription until the end of the period already paid for.

Your consumer rights under the Australian Consumer Law are not affected by this section.

6. Failed Subscription Payments

If a recurring payment fails, we or our payment provider may attempt to process the payment again or ask you to update your payment method.

Access to paid features may be suspended or terminated if payment remains outstanding.

We will not intentionally charge amounts beyond those authorised under the applicable purchase or subscription arrangement.

7. HSC Pass

Where HSCAssociate offers an HSC Pass, the specific inclusions, duration and price will be shown on the relevant purchase page.

Unless expressly stated otherwise, a current HSC Pass may provide:

• access to eligible HSCAssociate Library resources; and
• access to eligible HSCAssociate Platform features

for the access period stated at purchase.

Where the purchase page states that the HSC Pass costs A$700 as a one-time payment for 12 months, that payment does not automatically renew.

Unless expressly included on the purchase page, an HSC Pass does not include:

• private tutoring;
• paid online classes;
• products expressly sold separately; or
• services outside the stated Pass inclusions.

The HSC Pass provides account-based access only.

It does not give the purchaser ownership of HSCAssociate intellectual property or the right to download, redistribute or resell resources except where HSCAssociate expressly enables downloading.

8. Digital Resources and Library Access

HSCAssociate may sell or provide access to digital resources.

Unless expressly stated otherwise:

• access is personal to the authorised account;
• resources are provided through HSCAssociate's online Reader or Platform;
• purchasing access does not transfer ownership of the underlying intellectual property;
• resources may not be copied, redistributed, publicly uploaded or resold; and
• access lasts for the period shown at purchase.

Where a product provides 12 months of account-based Reader access, access expires at the end of that period unless extended or renewed by HSCAssociate.

A customer is purchasing the right to access the relevant resource for the stated period, not purchasing ownership of a PDF or other source file.

9. Online Classes

Paid classes are governed by these Terms together with the applicable HSCAssociate Class Terms and Cancellation Policy.

The class sales page will identify relevant information such as:

• class subject;
• price;
• class dates;
• number and duration of sessions;
• delivery method;
• instructor, where applicable;
• included resources;
• recording access, where offered; and
• the applicable resource-access period.

Unless expressly stated otherwise, purchasing a class does not include a general HSCAssociate Platform subscription.

If there is an inconsistency between these Terms and the Class Terms on a matter specifically relating to classes, the Class Terms apply to that matter.

10. Tutoring

Tutoring and managed tutoring services may be governed by separate tutoring terms.

Submitting a tutoring enquiry does not itself guarantee:

• availability of a tutor;
• acceptance of a requested tutor;
• a particular timetable; or
• commencement of tutoring.

Any applicable price, cancellation rules, recurring payment authorisation and tutoring arrangements will be disclosed under the applicable tutoring terms or arrangement.

11. Payments

Payments may be processed using third-party payment providers such as Stripe.

By making a purchase, you authorise the relevant payment provider to process the amount displayed for the product or service.

For recurring subscriptions or other services involving future authorised payments, the applicable recurring payment arrangement will be disclosed before you agree to it.

HSCAssociate does not generally store complete payment card numbers.

12. Receipts

Where available, payment receipts may be provided by HSCAssociate or our payment provider.

You are responsible for providing an accurate email address for payment and account communications.

13. Change-of-Mind Refunds

Except where expressly stated in a specific product policy, agreed by HSCAssociate, or required by law, HSCAssociate does not generally provide refunds solely because a customer:

• changes their mind;
• decides they no longer want a product;
• fails to use a purchased product or service;
• no longer requires the product;
• forgets to cancel a recurring subscription before a valid renewal; or
• purchases a product and later decides they would prefer a different HSCAssociate product.

This change-of-mind policy does not limit any right or remedy available under the Australian Consumer Law.

14. Incorrect or Duplicate Charges

If you believe you have been charged incorrectly or more than once for the same purchase, contact:

We will investigate the transaction and, where an incorrect or duplicate payment has occurred, provide an appropriate remedy.

15. Australian Consumer Law

Our products and services come with consumer guarantees that cannot be excluded under the Australian Consumer Law.

Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy that cannot lawfully be excluded.

For services, consumer rights may include rights to have a problem rectified, cancel a service contract in certain circumstances, receive a refund for an unused portion or reduced value, and receive compensation for reasonably foreseeable loss or damage where the law provides for those remedies.

Any discretionary refund policy operated by HSCAssociate is additional to, and does not replace, rights under the Australian Consumer Law.

16. Educational and AI-Generated Content

HSCAssociate provides educational assistance and study support.

Some features may use artificial intelligence or automated systems to:

• assess student responses;
• generate educational feedback;
• generate questions or practice activities;
• assist with study planning;
• suggest improvements; or
• provide other learning support.

AI and automated outputs may contain errors.

Students should use HSCAssociate feedback as an educational aid and exercise their own judgment.

HSCAssociate does not represent that AI-generated feedback is an official NESA, school, teacher or examination assessment.

17. No Guaranteed Academic Outcome

HSCAssociate does not guarantee:

• a particular HSC mark;
• a particular ATAR;
• a Band 6 or E4 result;
• a school assessment result;
• university admission;
• improvement by a particular number of marks; or
• any other specific academic outcome.

Educational outcomes depend on numerous factors outside HSCAssociate's control, including the student's effort, preparation, attendance, school assessments and examination performance.

18. Accuracy of Educational Content

We take reasonable steps to provide useful and accurate educational content.

However, educational materials may occasionally contain errors, become outdated or require correction.

Where we become aware of a material error, we may correct or update the relevant material.

Students should refer to official NESA materials where confirmation of current syllabus requirements, examination rules or prescribed texts is required.

HSCAssociate is not endorsed by or affiliated with NESA unless expressly stated.

19. Intellectual Property

Unless otherwise stated, HSCAssociate owns or licenses the intellectual property in its:

• website and Platform;
• software;
• study resources;
• study guides;
• questions;
• model responses;
• instructional materials;
• videos and recordings;
• branding;
• graphics;
• educational content; and
• other proprietary materials.

Purchasing access to a product gives you a limited, personal, non-exclusive and non-transferable right to use that product for your own educational purposes during the applicable access period.

You must not, without permission:

• reproduce substantial parts of HSCAssociate content;
• distribute resources to other people;
• sell or sublicense content;
• upload paid materials publicly;
• systematically scrape or extract content;
• circumvent access controls; or
• use HSCAssociate materials to create a competing commercial resource or service.

Nothing in this section prevents use that is expressly permitted by law.

20. Submitted Student Work

You retain ownership of original work that you submit to HSCAssociate.

You give HSCAssociate permission to process, store and use submitted work to:

• provide the requested educational service;
• generate marking or feedback;
• operate and improve relevant features;
• maintain security and service integrity; and
• otherwise handle the information as described in our Privacy Policy.

We do not obtain ownership of a student's original essay or response merely because it is submitted for marking.

21. Acceptable Use

You must not use HSCAssociate to:

• break the law;
• compromise another person's account or privacy;
• upload malicious software;
• interfere with the Platform;
• bypass payment or access controls;
• scrape or systematically extract content;
• harass other users, tutors, instructors or staff;
• impersonate another person;
• distribute another person's private information without permission; or
• use HSCAssociate in a manner that materially disrupts the service for others.

22. Suspension or Termination

We may reasonably restrict, suspend or terminate access where necessary because of:

• serious or repeated breaches of these Terms;
• fraud or attempted fraud;
• unauthorised account sharing;
• unlawful activity;
• threats to security;
• serious harassment or misconduct; or
• unpaid amounts relating to a service requiring payment.

Where reasonably practicable, we may provide notice and an opportunity to address the issue.

We will not exercise this right in a manner that unlawfully removes consumer rights in relation to a paid service.

23. Changes to Services

HSCAssociate may improve, modify or discontinue features from time to time.

We may make reasonable changes to features, design, functionality or content as the service develops.

Where a customer has purchased a specific paid product for a defined period, we will not intentionally remove the fundamental benefit of that purchase without providing an appropriate alternative or remedy where required.

24. Service Availability

We aim to keep HSCAssociate available and reliable, but continuous uninterrupted availability cannot be guaranteed.

The service may occasionally be unavailable due to:

• maintenance;
• software updates;
• outages;
• security incidents;
• third-party provider failures; or
• events outside our reasonable control.

This section does not exclude any rights that cannot lawfully be excluded.

25. Third-Party Services

HSCAssociate relies on third-party services including payment, hosting, database, authentication, artificial intelligence, email, analytics and video-conferencing providers.

Those third-party services may also be subject to their own terms and privacy policies.

HSCAssociate remains responsible for its obligations to customers to the extent required by applicable law.

26. Links to Other Websites

HSCAssociate may contain links to third-party websites or resources.

A link does not necessarily mean that HSCAssociate endorses or controls that third party.

Use of third-party websites is subject to their own terms and policies.

27. Privacy

Personal information is handled in accordance with the HSCAssociate Privacy Policy.

The Privacy Policy explains the types of personal information we collect, how we use and disclose it, use of technology providers, overseas processing, AI-related processing, security, access and correction, and privacy complaints.

28. Changes to These Terms

We may update these Terms from time to time to reflect changes to our services, business operations or legal requirements.

The current Terms will be published with the date of the latest update.

Where a change materially affects an existing paid service or recurring subscription, we will provide notice where reasonably appropriate or legally required.

29. Governing Law

These Terms are governed by the laws applicable in New South Wales, Australia.

Nothing in this section limits any rights a consumer may have under applicable Australian law.
